Terms of Service — Gatekeep

1. How Gatekeep Works

Gatekeep enables independent creators to publish digital content that users may unlock through payment.

Two unlock models may be available:

Private Unlock — A user pays to access specific content.
Crowd Unlock — Multiple users contribute toward a funding goal. When the goal is reached, content becomes accessible.

Access is granted digitally and may be limited to the purchasing account and/or device.

Creators may modify, disable, or remove their content at any time. Gatekeep does not guarantee permanent availability of any content.

Displayed currency may be estimated and may differ from the final charged currency shown at checkout.

2. Platform Role

Gatekeep is a technology platform only.

Gatekeep:

Does not create user content
Does not pre-screen content prior to publication
Does not endorse creators, products, or services
Is not responsible for third-party links

Creators act independently and are solely responsible for their content.

3. Accounts

Users must:

Provide accurate information
Maintain account security
Not share accounts to bypass unlock payments

Gatekeep may suspend or terminate accounts at its sole discretion.

4. Prohibited Content

Creators may not upload content that:

Contains nudity or sexual content
Promotes adult services
Contains hate speech or harassment
Promotes violence or illegal activity
Includes political campaigning or political persuasion
Contains misleading or fraudulent claims
Violates copyright or trademark laws
Uses third-party materials without rights

Gatekeep operates a zero-tolerance policy for prohibited content and may remove content or terminate accounts without notice.

5. Intellectual Property

Creators must only upload content they:

Created themselves, or
Have full legal rights to use

Creators must not upload copyrighted material without permission.

Gatekeep is not responsible for verifying ownership.

Creators agree to indemnify Gatekeep for any copyright claims.

Gatekeep branding, software, and design remain the property of Gatekeep.

6. Affiliate and Commercial Content

Creators may post product or affiliate links.

Creators are solely responsible for:

Disclosing affiliate relationships
Complying with advertising regulations
Accuracy of product claims

Gatekeep does not endorse or guarantee any linked product.

7. Payments, Fees, and Taxes

Payments are processed through Stripe or other third-party processors.

Gatekeep charges a 20% platform commission on creator earnings. Stripe processing fees apply separately.

Creators are responsible for:

Income tax
Self-employment tax
Local tax obligations

Where required by law, Gatekeep or its payment processors may collect and remit VAT, GST, or other applicable taxes.

Prices displayed may or may not include applicable taxes depending on jurisdiction.

8. Currency, Conversion, and Cross-Border Fees

Gatekeep may display prices in a local currency for convenience, but charges may be processed in a different currency depending on the buyer's location or payment method.

Buyers: Your bank or card issuer may apply foreign exchange rates, conversion fees, or international transaction fees. Gatekeep is not responsible for these fees or exchange rates.

Creators: Creator balances and payouts may be held and paid in supported currencies determined by Gatekeep and/or Stripe. If currency conversion is required, Stripe or the payment processor may apply an exchange rate and conversion fee.

Payout methods, supported currencies, and payout timelines vary by country. Gatekeep does not guarantee availability of all payout methods in every jurisdiction.

Refunds will not be issued due to currency conversion differences or bank/issuer fees.

9. Digital Content & Refund Policy

All purchases grant immediate access to digital content.

By purchasing, users:

Consent to immediate digital delivery
Waive applicable statutory withdrawal rights (including EU 14-day withdrawal rights)

All sales are final.

Refunds may only be issued in cases of technical malfunction, duplicate payment, or fraudulent activity.

Chargebacks may result in account suspension.

10. User Conduct & Anti-Scraping

Users may not:

Use bots or scraping tools
Share unlocked content publicly
Share accounts to bypass payment
Attempt to download content using automated means
Reverse engineer the platform

Unauthorized distribution may result in legal action.

11. DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

GATEKEEP MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED/ERROR-FREE SERVICE.

WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE BUG-FREE OR CONTINUOUSLY AVAILABLE.

12. Limitation of Liability

Gatekeep shall not be liable for:

User-generated content
Third-party links
Indirect or consequential damages
Loss of profits

Maximum liability is limited to the amount paid by the user in the previous 12 months.

13. Indemnification

Users agree to indemnify and hold Gatekeep harmless from claims arising from:

Their content
Their violation of these Terms
Their misuse of the Platform

14. Modifications to These Terms

We reserve the right to modify these Terms at any time.

We will notify users of material changes via the Platform or by email where appropriate.

Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

15. Termination

Gatekeep may suspend or terminate accounts at its sole discretion.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales.

For users located in the United States, disputes shall be resolved through binding arbitration where permitted by law.
